The Aviary is a game for identifying birds by their sound and building a virtual forest. Bird identification is powered by the on-device BirdNET model and is provided for enjoyment and learning.
Automated identifications can be wrong. Do not rely on The Aviary for scientific, legal, safety, or official record-keeping purposes. Always use your own judgment.
You are responsible for using the app lawfully. Recording laws vary by location — some places (including Florida and other “all-party consent” jurisdictions) restrict recording where people have a reasonable expectation of privacy or where a conversation may be captured. Only record where you are legally permitted to, and do not record people without their consent. You are solely responsible for how and where you record.
The app creates an anonymous account so your progress can sync. You are responsible for activity under your account. Don’t misuse the social features (globe, friends, trading) — no harassment, impersonation, or abusive forest names or content.
Don’t attempt to disrupt, reverse engineer, overload, or gain unauthorized access to the app or its services, and don’t use the app to break the law.
The Aviary uses BirdNET (Cornell Lab of Ornithology & Chemnitz University of Technology), used with the permission of the BirdNET team, and community media from iNaturalist in the Daily Challenge. Those components remain the property of their respective owners.
The app is provided “as is,” without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the app, including any consequences of how you choose to record.
We may update these terms as the app evolves. Continued use after an update means you accept the revised terms.
